TERMS AND LICENSING AGREEMENT
The party ordering services (Client) engages J House Photography and its agents to photograph, visually record, videotape, or otherwise create, whether through cameras, drones, or other technology, graphics, or other images (collectively “Media”) real and personal property. Client agrees to pay J House Photography in consideration of services rendered a fee by the schedule when booking online or as agreed on before incurring services. J House Photography retains ownership, including copyright, of all Media. Upon payment for Media, J House Photography grants Client a license to use Media. Client is prohibited from licensing, selling, or transferring (for fee or free) Media to third parties without the prior written consent of J House Photography. Media may not be altered without prior written consent of J House Photography. Client holds harmless J House Photography from any claims, demands, liabilities, costs, and expenses, including legal fees, resulting from the distribution and dissemination of Media.
COMPLIANCE WITH ADVERTISING STANDARDS & LOCAL LAWS
J House Photography provides professional image editing services at the specific direction of the Client. The Client acknowledges that various jurisdictions, Multiple Listing Services (MLS), and regulatory bodies have specific and evolving rules regarding the disclosure of "digitally altered" images. It is the sole responsibility of the Client to determine if the provided images require disclosure under local laws, professional codes of ethics, or MLS guidelines. By accepting and using these images, the Client assumes all liability for the proper disclosure and representation of the property in all marketing materials and agrees to hold J House Photography harmless from any fines, legal actions, or disciplinary measures resulting from the use or publication of these images.
